INTRODUCTION

This listing identifies endorsements available to modify the Insurance Services Office (ISO) Products/Completed Operations Liability Coverage Forms. The list is arranged by form number and title and includes a brief explanation of the use of each endorsement. This section does not include any state specific endorsements, changes or amendments. New endorsements introduced or endorsements changed in the 04 13 edition are in bold print.

TERMINATION AND SUSPENSION ENDORSEMENTS (CG 02)

CG 02 24–Earlier Notice of Cancellation Provided By Us

This endorsement changes the number of required days' notice of cancellation for other than nonpayment of premium to the number of days indicated for any statutorily permitted reason. It is used to increase the number of days notice to be more than the number required by state law.

DEDUCTIBLE ENDORSEMENTS (CG 03)

CG 03 00–Deductible Liability Insurance

This endorsement provides the means to include a deductible for Bodily Injury Liability, Property Damage Liability or Bodily Injury and Property Damage Liability combined, on either a per-claim or a per-occurrence basis.

Note: Certain classifications have footnotes specifically requiring use of a deductible.

ADDITIONAL COVERAGE ENDORSEMENTS (CG 04)

CG 04 24–Coverage for Injury to Leased Workers

This endorsement amends the definition of employee but only in the Employer's Liability exclusion. It eliminates leased workers as employees. This means that the employer’s liability exclusion no longer applies to leased workers and their injuries are covered.

CG 04 32–Year 2000 Computer-Related and Other Electronic Problems—Limited Coverage Options

This endorsement incorporates additional exclusions that eliminate coverage for any liability resulting from year 2000 computer-related and other electronic problems. The exclusion is inapplicable to any coverage or location that appears on the endorsement schedule.

CG 04 36–Limited Product Withdrawal Expense Endorsement

This endorsement reimburses the named insured's product withdrawal expenses. It does not provide any liability coverage or coverage for the cost or expense of defending claims or suits. It is subject to the aggregate limit, deductible amount, participation percentage for each product withdrawal, and cut-off date indicated on the endorsement schedule.

ADDITIONAL INSURED ENDORSEMENTS (CG 20)

CG 20 01–Primary and Non-Contributory–Other Insurance Condition (04 13 addition)

This endorsement states that coverage for additional insureds is on a primary and non-contributory basis but only when contractually required. The non-contributory agreement applies only to policies where the additional insured is a named insured.

CG 20 03–Additional Insured–Concessionaires Trading Under Your Name (04 13 changes)

This endorsement adds any concessionaire on the endorsement schedule as an additional insured but only with respect to its liability as a concessionaire that trades under the named insured's name. Coverage is limited to what the law permits. When the endorsement is required by contract, coverage and limits are further limited to not being broader than what that contract requires.

EXCLUSION ENDORSEMENTS (CG 21)

CG 21 33–Exclusion–Designated Products

This endorsement excludes coverage for bodily injury or property damage included in the products/completed operations hazard arising out of only the named insured's products described on the endorsement schedule.

CG 21 34–Exclusion–Designated Work

This endorsement excludes coverage for bodily injury or property damage included in the products/completed operations hazard arising out of only the named insured's work described on the endorsement schedule.

CG 21 39–Contractual Liability Limitation

This endorsement replaces the definition of Insured Contract to include only certain, specific written contracts. The covered contracts include lease of premises, except for fire damage, sidetrack agreements, easement or license agreements, obligations required by ordinance to indemnify a municipality, except for work in connection with the municipality, and elevator maintenance agreements.

CG 21 41–Exclusion–Intercompany Products Suits

This exclusion eliminates coverage for damage claims brought by one named insured that arises from another named insured's products.

CG 21 61–Exclusion–Year 2000 Computer-Related and Other Electronic Problems–Products/Completed Operations

This endorsement excludes coverage for losses included in the definition of products/completed operations hazard and arising directly or indirectly out of the failure of computers and related equipment to correctly recognize and handle the year 2000 and later dates.

CG 21 64–Year 2000 Computer-Related and Other Electronic Problems–Exclusion of Specified Coverages for Designated Products or Completed Operations

This endorsement excludes coverage for losses that arise directly or indirectly out of the failure of computers and related equipment to correctly recognize and handle the year 2000 and later dates. It applies to only the types of injury or damage for the products or completed operations described on the endorsement schedule.

CG 21-98–Total Pollution Exclusion Endorsement

This endorsement replaces the pollution exclusion in the Products/Completed Operations Liability Coverage Form with a total pollution exclusion. It is similar to CG 21 49–Total Pollution Exclusion Endorsement.

CG 21 99–Total Pollution Exclusion for Designated Products or Work (04 13 addition)

This endorsement is identical to CG 21 98–Total Pollution Exclusion Endorsement except that it applies only to the product or work on the endorsement schedule. All other work or products remain subject to the policy level pollution exclusion.

SPECIAL PROVISIONS FOR CERTAIN TYPES OF RISKS ENDORSEMENTS (CG 22 & 23)

CG 22 57–Exclusion–Underground Resources and Equipment

This endorsement applies to gas and oil operations. It excludes coverage for property damage losses included in the underground resources and equipment hazard as well as related expenses.

CG 22 63–Stevedoring Operations Limited Completed Operations Coverage

This endorsement restricts coverage through an addition to the definition of products/completed operations hazard. The amended definition excludes coverage for completed operations that are not on board a vessel.

CG 22 81–Exclusion–Erroneous Delivery or Mixture and Resulting Failure of Seed To Germinate–Seed Merchants

This endorsement excludes coverage for property damage due to seed failing to germinate. It also excludes property damage because of erroneous delivery of seed and improper mixing of the seed formula.

COVERAGE MODIFICATION ENDORSEMENTS (CG 24)

CG 24 01–Non-Binding Arbitration

This endorsement establishes the framework and working rules for submitting a claim made against the insured to non-binding arbitration when coverage is disputed.

CG 24 02–Binding Arbitration

This endorsement establishes the framework and working rules for submitting a claim made against the insured to binding arbitration when coverage is disputed.

CG 24 03–Waiver of Charitable Immunity

This endorsement states that the insurance company agrees to not exercise an insured’s charitable immunity in both adjusting and defending claims. The insured still has the right to request the carrier to claim charitable immunity if it does so in writing.

CG 24 04–Waiver of Transfer of Rights of Recovery against Others to Us

This endorsement amends the Transfer of Rights of Recovery against Others to Us condition. The insurance company waives its rights of recovery against the party listed on the endorsement schedule.

CG 24 07–Products/Completed Operations Hazard Redefined

This endorsement replaces the definition of products/completed operations hazard to remove the requirement that damages occur off premises.

CG 24 10–Excess Provision–Vendors

This endorsement amends the Other Insurance condition when the named insured is added to a manufacturer or distributor's policy as an additional insured because it is a vendor of their products. It makes this coverage excess over any valid and collectible insurance available to the insured as an additional insured under a policy issued to a manufacturer or distributor for products manufactured, sold, handled or distributed.

CG 24 20–Seed Merchants–Coverage for Erroneous Delivery or Mixture and Resulting Failure of Seed to Germinate

This endorsement adds property damage coverage for loss that results from seed delivered in error or mixed improperly. It includes any resulting lack of germination. Misdelivery means failure to deliver seed, delivering the wrong seed, or delivering seed at the wrong time of the year or season.

CG 24 21–Seed Merchants–Coverage for Erroneous Delivery or Mixture (Resulting Failure of Seed to Germinate Not Included)

This endorsement adds property damage coverage for loss that results from seed delivered in error or mixed improperly. It does not include any resulting lack of germination. Misdelivery means failure to deliver seed, delivering the wrong seed, or delivering seed at the wrong time of the year or season.

CG 24 26–Amendment of Insured Contract Definition (04 13 changes)

This endorsement amends the definition of Insured Contract. It reduces coverage by changing paragraph 9. f. in two ways. First, paragraph 9.f. applies only when the named insured or a party that works on its behalf causes the bodily injury or property damage. Second, it applies only if the law permits the named insured to assume the liability.

CLAIMS MADE ENDORSEMENTS (CG 27)

CG 27 03–Amendment Of Section V–Extended Reporting Periods for Specific Accidents, Products, Work or Location

(Use with CG 00 38)

This is the required extended reporting period endorsement that CG 27 02–Exclusion of Specific Accidents, Products, Work, or Location addresses. It provides an automatic limited extended reporting period for the specific accidents, products, work, or location(s) described on the endorsement schedule without charging an additional premium. There is also an option to purchase an extended reporting period with no time limitation on the accidents, products, work, or location(s) that the renewal claims-made coverage specifically excludes.

CG 27 05–Exclusion of Specific Accidents, Products, Work or Location

(Use with CG 00 38)

This endorsement modifies coverage, eliminating protection against losses due to accidents, locations, products, or work described on the endorsement schedule. It contains provisions for extended reporting periods that refer to CG 27 03–Amendment of Section V–Extended Reporting Periods for Specific Accidents, Products, Work, or Location. As a result, CG 27 03 must also be attached.

Note: As this form’s language refers to a current and a prior term, it also affects the application of form CG 27 03. All policy terms should be examined to assure that companion endorsements have been attached as needed.

MISCELLANEOUS COVERAGE FORMS AND ENDORSEMENTS (CG 28 AND 29)

CG 28 34–Supplemental Extended Reporting Period Endorsement

(Use with CG 00 38)This endorsement provides an extended reporting period without a time limitation. It specifies that the insurance is excess insurance that cannot be cancelled if the premium is paid when due. The named insured must request the endorsement in writing within 60 days after the end of the policy period.

CG 28 35–Supplemental Extended Reporting Period Endorsement for Specific Accidents, Products, Work or Locations

(Use with CG 00 38)This endorsement provides an extended reporting period without a time limitation for those accidents, products, work, or locations listed on the endorsement schedule on CG 27 05–Exclusion of Specific Accidents, Products, Work, or Location. It specifies that the insurance is excess insurance that cannot be cancelled when the premium is paid. The named insured must request the endorsement in writing not later than 60 days after the end of the policy period.

CG 29 52–Amendment of Liquor Liability Exclusion (04 13 changes)

This endorsement revises the liquor liability exclusion to apply when a named insured regularly serves alcoholic beverages or permits persons who purchased alcohol off-site to consume it on the premises, even if it is not considered to be in a liquor-related business.

CG 29 53–Amendment of Liquor Liability Exclusion–Exception for Scheduled Premises or Activities
(04 13 changes and title change)

This endorsement is identical to CG 29 52–Amendment of Liquor Liability Exclusion but entries can be made on the endorsement schedule for activities where the liquor exclusion does not apply. However, it includes coverage for certain specifically described activities, such as company picnics or year-end parties where alcohol may be provided. It also does not apply at scheduled premises where persons are allowed to bring and consume their own alcoholic beverages.

MISCELLANEOUS ENDORSEMENTS AND EXCLUSIONS (CG 31, 33 & 99)

CG 31 31–Fungi or Bacteria Exclusion

This endorsement excludes liability coverage for losses related to fungi or bacteria on or in a building or structure and its contents. It also excludes loss, costs or expenses the insured or others incur to test for or clean up fungi or bacteria. This exclusion does not apply to any fungi or bacteria on or contained in a product intended for bodily consumption. Specific coverage for losses caused by fungi or bacteria can be bought back using form CG 31 32–Limited Fungi or Bacteria Coverage.

CG 31 32–Limited Fungi or Bacteria Coverage

This endorsement provides buy back coverage for fungi and bacteria losses excluded by CG 31 31–Fungi or Bacteria Exclusion. Coverage is subject to the aggregate limit indicated on the endorsement schedule.

CG 31 67–Exclusion–Exterior Insulation and Finish Systems

This endorsement excludes coverage for bodily injury or property damage losses due to any aspect of any exterior insulation and finish system or its component parts from manufacturing through installation and/or repair.

CG 33 53–Exclusion - Access or Disclosure of Confidential or Personal Information and Data-Related Liability - With Limited Bodily Injury Exception (05/14 addition)

This mandatory endorsement excludes all damages, except for bodily injury, that are due to cyber security related items such as the disclosure nonpublic information. It also excludes all damages that are due to electronic data use and access.

Note: Endorsement CG 33 59 cannot be attached when CG 33 53 is attached.

CG 33 59–Exclusion - Access or Disclosure of Confidential or Personal Information and Data-Related Liability - Limited Bodily Injury Exception Not Included (05/14 addition)

This endorsement can be used in place of the CG 21 07.  It excludes all damages, including for bodily injury, that are due to cyber security related items such as the disclosure nonpublic information. It also excludes all damages that are due to electronic data use and access.

Note: Endorsement CG 33 53 cannot be attached when CG 33 59 is attached.

CG 33 70–Silica or Silica-Related Dust Exclusion

This endorsement excludes liability coverage for losses arising out of any aspect or element of silica or silica-related dust. It includes definitions of Silica and Silica-related Dust.

CG 33 76–Communicable Disease Exclusion

This endorsement excludes losses due to alleged or actual transmission of communicable diseases.

INTERLINE ENDORSEMENTS (IL)

IL 00 03–Calculation of Premium

This endorsement is used on multiple year policies to calculate revised premiums at each anniversary.

IL 00 17–Common Policy Conditions

This mandatory endorsement provides the common policy conditions.

IL 00 21–Nuclear Energy Liability Exclusion Endorsement (Broad Form)

This endorsement excludes all losses caused by or resulting from the hazardous properties of nuclear materials. It includes definitions for Hazardous Properties, Nuclear Material, Source Material, Spent Fuel, Waste, Nuclear Facility, Nuclear Reactor and Property Damage.

IL 09 11–Supplement to Retrospective Premium Endorsement (Final Premium Computation)

This endorsement is attached to all policies subject to Retrospective Rating Plan D and to modify retrospective rating plan rules to leave retrospective ratings open until the insurance company requests a final adjustment. It changes the premium calculations and payments provision of the Retrospective Premium Endorsement with respect to the final premium calculation.

IL 09 18–Retrospective Premium Endorsement–One Year Plan–Multiple Lines

This endorsement provides information and details for retrospectively rated insurance coverages. It includes a schedule for developing premiums for one-year plans. The amount of retrospective premium is based on five standard elements and two elective elements listed and described in the endorsement.

IL 09 19–Retrospective Premium Endorsement–Three Year Plan–Multiple Lines

This endorsement provides information and details for retrospectively rated insurance coverages. It includes a schedule for developing premiums for three-year plans. The amount of retrospective premium is based on five standard elements and two elective elements listed and described in the endorsement.

IL 09 20–Retrospective Premium Endorsement–Long-Term Construction Project–Multiple Lines

This endorsement provides information and details for retrospectively rated insurance coverages. It includes a schedule for developing premiums for long-term construction projects. The amount of retrospective premium is based on five standard elements and two elective elements listed and described in the endorsement.

IL 09 21–Retrospective Premium Endorsement–Short Form

This endorsement provides for adding a policy into an existing retrospective premium endorsement rating procedure.

IL 09 22–Retrospective Premium Endorsement–Exclusion of Aviation Exposures

This endorsement exempts the scheduled aviation exposures from being included in the retrospective rating agreement.

IL 09 23–Retrospective Premium Endorsement–Exclusion of Retrospective Development Factors

This endorsement deletes the reference to any Retrospective Development Factors in the states scheduled.

IL 12 01–Common Policy Changes

This generic change endorsement permits various changes that affect all parts of the coverage form.
